There can be many repercussions for a DWI offense. A driver that is convicted for a DWI may face potential jail time, fines, community service and will lose their driver's license. However, depending on your case, if you are convicted for DWI, you may be eligible for a Limited Driving Privilege to allow you to drive during the period of suspension. At the Law Office of Yolanda M. Trotman, PLLC, we can help. Our attorney has handled hundreds of drunk driving cases as an Assistant Public Defender, and now as a private attorney.

Ms. Trotman is an experienced trial lawyer and helps clients challenge the legal grounds of DUI/DWI arrests. A DWI citation can be challenged on various grounds. First, there must be reasonable suspicion for the original traffic stop. Second, there must be probable cause for the officer to arrest the driver for Driving While Impaired. Third, there may be constitutional grounds to challenge the arrest. Finally, we can help clients challenge the case based on other procedural grounds or because of a lack of showing of appreciable impairment.

Alcohol Assessments
In North Carolina, an alcohol assessment and treatment will be required with any entry of a guilty plea in a Driving While Impaired case. If you get an assessment in advance of the resolution of your case, you may have a better resolution to your case by providing mitigating factors to the court. We can advise you on how to obtain an alcohol assessment and recommend local agencies for you.

Limited Driving Privileges
When you are arrested for Driving While Impaired, your driver's license will be suspended for 30 (thirty) days. However, you may be eligible for a Limited Driving Privilege for work purposes in as little as 10 (ten) days from the date of your arrest. This type of privilege will allow you to drive during the balance of the 30 (thirty) day period of suspension. Certain requirements and monetary obligations must be met before a Limited Driving Privilege is granted by the Court.

The first conviction for Driving While Impaired will result in a suspension of your driver's license for a period of one year. However, if you had a valid driver's license, or a license that was suspended or revoked for less than one year, you may be eligible for a Limited Driving Privilege if your case is resolved through a finding of guilt. This will allow you to drive during your suspension period. There are a number of requirements you will have to meet to obtain a Limited Driving Privilege. Our office can guide you through that process. Additional convictions for Driving While Impaired may not allow you to obtain a Limited Driving Privilege.

The Law Office of Yolanda M. Trotman, PLLC can also negotiate a favorable plea agreement with the prosecutor when there are mitigating circumstances.
